The Petitioners have approached this Court in peculiar circumstances.
It is the contention of the Petitioners that the seats which were to be filled in by the State Government remained unfilled, as a result of which 32 seats for PGD course have remained vacant. Learned AGP on instructions states that eighteen seats, which were available with the State Government have been surrendered to the institution on 20 May, 2016 for filling the seats from eligible Pg 1 of 2
929.wpst.14925.2016.doc candidates as per notification dated 7 May, 2016. Learned counsel for the Petitioner submits that despite making attempts to fill up the seats as per aforesaid notification, there are still 32 seats remained to be filled up. In that view of the matter, we find that if the seats are kept vacant, no purpose will be served. It is to be noted that tomorrow is the last day for filling up the seats as per order passed by Hon'ble Supreme Court.
In that view of the matter, we permit Petitioner No.3 to fill up 32 seats for academic year 2016-17 from outside the state who had appeared and passed AIPMT - 2016 (NEET-1), by inter se merit. ( B. P. COLABAWALLA J. ) ( B.R. GAVAI J. ) Pg 2 of 2
