This is an application for anticipatory bail in C.R. No.13 of 2017 registered with Kandivali Police Station, Mumbai for offences under Section 406, 420 of Indian Penal Code (for short "IPC"). 2.

The case of the prosecution is that the gold was entrusted to the co-accused. He was recently arrested and during the course of interrogation he had disclosed that the gold was handed over to the applicant by the co-accused.

The contention of the applicant is that he has not received any gold from the co-accused.

Learned APP submitted that the interrogation of the arrested accused revealed the complicity of the applicant. In the past C.R. No. 7 of 2010 registered with D. B. Marg Police Station for offences under Sections 465, 467, 468 r/w Section 34 of IPC and another case registered with Juhu Police Station which was subsequently transferred to EOW vide C.R. No. 21 of 2013. It is submitted that the applicant is also involved in both these cases. Learned counsel for the complainant also reiterated the submissions of learned APP.

The complicity of the applicant is disclosed during the course of investigation. The applicant has antecedents. No case for grant of anticipatory bail is made out.

ORDER

Anticipatory Bail Application No. 1531 of 2021 is rejected and disposed of accordingly;
