It is the case of the appellant that Mr.Sabhala @Sabalal Manguram Patel had already purchased the offending vehicle from the appellant Mr.Khalik Mahamad Anwar Siddiqui before the date of the unfortunate accident.

Learned advocate for the original claimant has opposed this

It is the case of the appellant that there were documents on record to show that the owner of the vehicle was not Mr.Khalik Mahamad Anwar Siddiqui but it was Mr.Sabhala @Sabalal Manguram Patel . Learned advocate for the original claimant states that it is a false statement because it is not stated in the written statement. He however states that in fact there is a categorical statement made in the written statement that Mr.Sabhala @Sabalal Manguram Patel was a driver of Mr.Khalik Mahamad Anwar Siddiqui.

In my view, in the interest of justice, it would be necessary to add Mr.Sabhala @Sabalal Manguram Patel as a party respondent to this First Appeal.

Interim application is allowed in terms of prayer clause (a). Interim application is disposed of.

Amendment to be carried out forthwith.
