Heard. The learned counsel for the Appellant submits that the MJ petition No.961/2002 is finally decided by the Family Court on 13/08/2013. She submits that the present Appeal from Order is preferred challenging the order dated 18/03/2013 passed below Exhibit 50.

In view of subsequent development, the Appellant seeks leave to withdraw the present Appeal from Order with liberty to take out appropriate proceedings for the same cause of action.

Hence, the appeal stands dismissed as withdrawn with liberty as prayed for.
