The farad reflects that petitioner no. 2 Vijay Khisty has already expired whereas petitioner no. 1 Dilip Naik is not traceable. Both these petitioners are accused in Criminal Case No. 2/2004 pending on the file of Judicial Magistrate First Class, Pune Cantonment for offence punishable under Section 500 r/w 34 of the Indian Penal Code.

In view of the fact that petitioner no. 2 is dead and petitioner no. 1 is not traceable, no purpose will be served in issuing fresh notice to petitioner no. 1.

That being so, petitions stand dismissed for want of prosecution.
