Learned Counsel for the applicant seeks leave to withdraw the application. He states that during the pendency of this application, charge-sheet has been filed and that the applicant intends SQ Pathan 1/2

ba.1168.19.903.doc to approach the trial Court by filing an application after filing of the charge-sheet.

Accordingly, the application is disposed of as withdrawn. It is made clear that this application has not been heard on merits and if an application is filed after filing of the charge-sheet, the same shall be decided by the learned Judge, on its own merits, uninfluenced by the withdrawal of this application.

In view of the above order, nothing survives for consideration in the intervention application being Criminal Application No. 733 of 2019. The same is disposed of accordingly.
