Learned APP at this stage submits that in fact, recording of substantive evidence is almost concluded and the case is posted for recording of statement of the accused under Section 313 of the Code of Criminal Procedure, 1973. At this stage, it would not be appropriate to decide the application seeking bail on merits. The matter is subjudiced for appreciation of evidence before the learned Sessions Judge and in view of this, the application stands rejected.
