Learned advocate for the Appellant on written instructions seeks leave to withdraw the Appeal. The communication dated 3rd January, 2023 signed by the Commissioner, Municipal Corporation shows that now the matters are settled out the Court. In view of this settlement by the Corporation, now the amount of compensation is also deposited in the Execution Court. The written communication is taken on record and marked as Annexure-"X" for the purpose of identification. 2.

In view of the above, Appeal is allowed to be withdrawn and is disposed of.
