The learned counsel for the applicant submits that on 9.3.2017, he was instructed to withdraw the application. It is also submitted that the applicant is suffering from Ischaemic heart disease since the year 2016. The learned counsel also submits that the offence alleged is of the year 2010. However, the first information report is filed on 22.2.2016. However, at this stage, it would not be necessary to go into the merits of the matter as the application was withdrawn on instructions. The learned counsel for the applicant has placed reliance on the certificates issued by Dr. B.N.Shahane and Asian Heart Institute.

The learned counsel for the applicant, upon instructions, seeks liberty to withdraw the application. Liberty as prayed for is granted in the
Mhi 2 ABA-937-17.sxw interest of justice.

The applicant shall appear before the concerned Magistrate on or before 31.8.2017. The learned Magistrate shall preferably decide the application on the same day uninfluenced by the withdrawal of the two applications. The applicant stands protected till 5.00 p.m. on 31.8.2017.
