By this Application, the Applicant seeks suspension of sentence and enlargement on bail pending hearing and final disposal of the appeal.

The Applicant was co-accused in Special MPID Case No.3 of 2016 and was tried for offences under Section 406, 420 of IPC and Section 3 of MPID Act. He has been held guilty and has been sentenced to undergo R.I. for 5 years and to pay fine of Rs.1,00,000/- each i.d. to undergo S.I. for 3 years. 3.
Mr.Patil, learned Counsel for the Applicant states that the
other co-accused being Director and Chairman have been released on bail. He has placed on record copy of Order dated 02.07.2021 in Interim Application No.1156 of 2021 in Criminal Appeal No.506 of 2021. It is not in dispute that the Applicant herein who was the Treasurer of the Sanstha was on bail pending trial. He has not misused his liberty.

In view of the reasons recorded in Order dated 02.07.2021, in my considered view, the Applicant is also entitled for bail pending hearing and final disposal of the appeal. Hence Application is allowed on the following terms and conditions: (i) The Applicant be released on cash bail in the sum of Rs.25,000/- for a period of eight weeks;
(ii) The Applicant shall within the said period of eight weeks, furnish P.R.Bond in the sum of 25,000/- (Rs. Twentyfive Thousand Only) with one or two sureties in the like amount;
(iii) The order directing the Applicants to deposit fine, is stayed, pending the hearing and final disposal of this Appeal;
(iv) The Applicants shall report to the trial Court, once in
six months on the day/date specified by the trial Court, till the appeal is finally disposed of;
(v) The Applicant shall keep the trial Court informed of his current address and mobile contact numbers and/or change of residence or mobile details, if any, from time to time; (vi) If there are two consecutive defaults in appearing before the trial Court, the learned Judge shall make a report to the High Court and the prosecution would be at liberty to file an application seeking cancellation of bail. 5.
The application is accordingly disposed of.
