Heard the learned Counsel for the Applicant and the learned APP for State.

This is subsequent application seeking pre-arrest bail under section 438 of the Code of Criminal Procedure, 1973. The previous application i.e. Criminal ABA No. 650 of 2016 was Talwalkar 1/2

2.aba938.17.sxw withdrawn on 21st March, 2017. This Court had specifically observed as follows :

"The learned Counsel for the applicant after arguing at length seeks liberty to withdraw the application."

The learned Counsel appearing for the Applicant had prayed for protection for a limited period and hence, this Court had directed the Applicant to surrender before the the concerned Magistrate on or before 30th March, 2017 and the applicant was protected till 5 p.m. of 30th March, 2017.

The Applicant has committed breach of the Order dated 21st March, 2017. It is clear that the application was argued on merits. Hence, the present Anticipatory Bail Application stands rejected. The investigating agency to take appropriate steps. (SMT. SADHANA S. JADHAV,J) Talwalkar 2/2
