At the outset, Mr. Mishra, the learned Counsel appearing for the Petitioner states that he is restricting this petition to the relief claimed in prayer clause (a). Statement accepted. 2.

Prayer clause (a) of the petition reads thus : "a) that this Hon'ble Court be pleased to issue appropriate writ, order and direction directing the Respondent not to disturb the Petitioner's exclusive use, occupation and possession in respect of the premises being Flat No. F1501, situated at Octacrest Building Lokhandwala Township, Akurli Road, Kandivali (E), Mumbai - 400101 and/or not to terrorise the Petitioner to hand over the keys in respect of the said flat too the father in law or the husband of the Petitioner in any manner whatsoever."

The Petitioner alleges that she is in possession of the said flat and her father-in-law with the help of Respondent No. 2 police officer wants to enter into the said flat.

Mr. Saste, the learned APP having taken instructions from the concerned officer states that the police have nothing to do with the alleged possession of the Petitioner, police are investigating the complaints made by the husband. The learned APP also denied that Respondent No. 2 is helping father-in-law of the Petitioner in getting entry in the subject flat.
