IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CIVIL APPELLATE JURISDICTION APPEAL FROM ORDER NO. 552 OF 2016 WITH CIVIL APPLICATION NO. 709 OF 2016 AND CIVIL APPLICATION NO. 587 OF 2017 Pradnya Pratap Ghate ...Appellant

Versus

Bhagvan Laxman Pawar & Anr

...Respondents

Mr Vernekar, with Abhay Thorat, for the Appellant.

CORAM: G.S. PATEL, J DATED:

10th July 2017 PC:- 1.

The Appeal is directed against an ad-interim order dated 4th May 2016, by which the Trial Court in exercise of its discretion, declined, and in my view quite correctly, the ad-interim reliefs and set the Notice of Motion down for hearing and final disposal. Given the nature of relief sought in the Notice of Motion, this was in fact the only order that was possible.

2.

The Notice of Motion will he heard and disposed on its own merits.

10th July 2017

10-AO552-16+.DOC 3.

The Appeal from Order is disposed of in these terms with no order as to costs.

4.

The Civil Applications do not survive and are disposed of as infructuous.
