---------- CORAM :

Sharayu. 1/4

DATE : 12 July 2017 ORDER :

1.

Writ Petition No. 5842 of 2017 is not on board. Taken on board.

2.

In pursuance to the ad-interim orders passed by this Court, both the Petitioners were permitted to appear for the interview. The performance of both the Petitioners has also been assessed by the Selection Committee consisting of seven experts. 3.

On the last date, when the matter was listed, we thought that before hearing the Petitions on merits, it would be more appropriate that the Court peruses the recommendations of the Selection Committee. This was also inasmuch as only when the Petitioners are to be found in the select list, there would be purpose in deciding the Petition on merits. As such, we had requested the learned Counsel appearing for the University to keep the proceedings of the Selection Committee Sharayu. 2/4

available to us in the sealed envelop.

4.

Today the proceedings of the Selection Committee are produced before us in the sealed envelop. We have scrutinised them. The proceedings are returned. 5.

Associate is directed to return the proceedings to the learned Counsel for the Respondent University in the sealed cover.

6.

Upon perusal of the personal selection, we find that neither of Petitioners have been in a position to find place either in the select list or wait list.

7.

In that view of the matter, the only issue remaining for consideration only is for the academic purposes. We are therefore not inclined to entertain the present Petitions. The Writ Petitions are rejected.

8.

The learned Judges of the Division Bench of this Sharayu. 3/4

Court at Nagpur Bench has directed that the result should not to be declared in respect of the Akola University. 9.

In that view of the matter, there should be no impediments in the Respondent Board in declaring the result insofar as the University other than the Akola University are concerned. Needless to state that if the Petitioners are aggrieved by the decision of the Selection Committee on any of the grounds that are available, they are free to agitate their grievances before appropriate forum.
