This is an application for restoration of Criminal Application bearing No.224 of 2018.

Heard the applicant, who is appearing in person. He submits that in Criminal Application No.224 of 2018, notice to avk 1/2

4-APPP-583-2018.doc respondents was not issued, and therefore, in the present application there is no need to issue notice to respondent no.1 Priya. The applicant, who is appearing in person, submits that because of his preoccupation in preparation for LL.B Examination, he could not attend the court when the matter was fixed. Having considered the submissions so advanced and considering the pleadings in the application, I hold that the applicant was prevented by sufficient cause in not appearing before the court when the application was called out for hearing. Hence, the order :

ORDER

i) Criminal Application No.583 of 2018 is allowed. ii) Order of dismissal in default of Criminal Application No.224 of 2018 is recalled and the said application is restored to file.

iii) The application is accordingly disposed of.
