Application is moved for anticipatory bail. Applicant/accused is apprehending arrest in C.R. No. 175 of 2015 registered with Baramati City police station, Pune for the offences punishable under Sections 326, 324, 323, 504 and 506 of the Indian Penal Code. 2.
It is the case of the prosecution the complainant Sunil Khomane was working in one credit society namely "Sidhhiraj Nath Patsanstha". The applicant/accused has borrowed loan of Rs. 24 lacs from the said credit society. On 29th May, 2015 when the complainant went to the shop of the applicant/accused for recovery, at that time, there was some altercations between them and the applicant assaulted him with fist 1 / 3
blows and kicks on his chest and face. Therefore the complainant suffered deafness. He went to the hospital, took medical treatment and thereafter lodged the complaint.

The learned counsel for the applicant/accused has submitted that there is no grievous injury. The applicant/accused did not use any weapon but it was an assault out of sudden provocation. He submitted that the applicant/accused has paid the entire medical expenses of the complainant in this injury and also undertakes to pay further medical expenses by cheque hereinafter.

The learned prosecutor opposed the application. She relied on the complaint.

Perused the injury certificate and the complaint. On instructions from the investigating officer, it is informed by the prosecutor that today the physical condition of the complainant is improved. He has not lost his capacity to hear.

Under these circumstances, I confirm the interim bail granted to the applicant/accused on 9th June, 2015 on condition that the 2 / 3
applicant/accused shall cooperate with the Investigating Officer and shall attend Baramati City police station, Pune once in a week on every Monday between 6.00 pm to 7.00 pm till 20th July, 2015. (MRS.MRIDULA BHATKAR, J.) 3 / 3
