Issue notice. Learned APP. waives notice on behalf of respondent State and seeks time to file afÏdavit in reply. Investigating ofÏcer is present. Perused the case diary. Admittedly applicant has approached this court after rejection of his third anticipatory bail application by the learned Trial Judge by its order dated 15.4.2019. Perusal of case diary would reveal of assault by scythe by applicant by its blunt side on - Page-1/2

Nalawade 905-aba-1054-19.doc head and on the back of complainant in the course of same incident. He is also assaulted by some other accused persons. Injuries sustained by complainant are corroborated by injury certificate on record. Admittedly there are also three eye witnesses who had named applicant as well as complainant.
