In view of this, upon instructions, the learned counsel for the applicant seeks liberty to withdraw the application. Liberty as prayed for is granted in the interest of justice with further liberty to approach the Sessions Court in the changed circumstances.

The learned Sessions Judge shall decide the application on its own merits without being influenced by the withdrawal of this application. 4.
