P.C.:­ The Applicant is apprehending arrest in CR No. 170 of 2018 dated 21st March, 2018 registered with Vikroli Police Station, Mumbai under Sections 420, 406, 467, 468, 471, 504 and 506 read with Section 34 of the Indian Penal Code.

Heard the learned counsel for the Applicant and the learned APP. Perused the record.

The learned counsel for the Applicant submitted that, the co­accused Suresh Tiwari has been granted pre­arrest bail by this Court by its Order dated 26th July, 2018. He submitted that Suresh Tiwari is beneficiary of Rs.15 lakhs in the present crime. He further 1/3

ssm 2 909-aba1056.19.doc submitted that, the co­accused Asif Qureshi is alleged to have been received Rs.6 lakhs in the present crime. It is submitted that as per the first information report itself co­accused Sayyad Abrar is alleged to have been received Rs. 4 lakhs by way of bank transfer. He submitted that, thus the said three co­accused persons are beneficiary of the said amount of Rs. 25 lakhs involved in the present crime. The record indicates that, the Applicant has simplicitor acted as intermediary along with the said other three co­accused persons and has not been benefited from the proceeds of the crime. In view thereof, the custodial interrogation of the Applicant for further investigation is not necessary and the accused can be granted pre­arrest bail.

Hence, the following order­ a) In the event of arrest in CR No. 170 of 2018 dated 21st March, 2018 registered with Vikroli Police Station, Mumbai, the Applicant shall be released on bail on his furnishing PR bond of Rs.25,000/­ with one or two solvent local sureties in the like amount. b) The Applicant shall not tamper with the evidence 2/3
