The petitioner is aggrieved by order dated 28th February, 2020, passed by Ad-hoc District Judge-2, Kolhapur. The Appeal preferred by the petitioner is pending before the said Court. The application for stay of the impugned order passed by the trial Court has been rejected. The Appeal is pending before the Appellate Court since 2019.

Learned counsel for the petitioner submitted that the petitioner is without interim relief. The Appeal is pending before the Sessions Court. The petitioner has good case on merits.

rpa 2/3 31wp5102of2021.doc Considering the fact that the Appeal preferred by the petitioner is pending before the Sessions Court since 2019, appellate Court can be directed to make an endeavour to dispose of the Appeal expeditiously.

Considering the aforesaid circumstance, I pass the following order:

(i) Criminal Appeal No.17 of 2019, preferred by the Petitioner before the Court of Ad-hoc District Judge-2, Kolhapur, is directed to be decided expeditiously and within a period of eight weeks from the date of the receipt of this order;

(ii) It is clarifed that this Court has not adjudicated the petition on merits;

(iii) Both the parties shall co-operate with the Sessions Court in expeditious disposal of the Appeal;
