Applicant was arrested on 23/12/2020 in Crime No. 423 of 2020 registered with Bhiwandi City Police Station for the offence punishable under Sections 328, 273, 276 of the Indian Penal Code and Section 18C, 18A, 27B and 28A of Drugs & Cosmetics Act, 1940 and Section 8(c) and 22 of Narcotic Drugs and Psychotropic Substances Act.

2] Submissions of Counsel for Applicant are, quantity of drugs Codeine which is found in possession of the Applicant is below commercial quantity.

There is strong prima facie evidence which may result into conviction of the Applicant under the provisions of the NDPS Act.
