This application is preferred by the Applicant seeking anticipatory bail in connection with NBW issued by the Sessions Court in Criminal Appeal No. 76 of 2023.

Learned APP raised an objection that the application is not maintainable under section 438 of Cr.P.C. Instead the Applicant will have to file appropriate proceedings challenging issuance of NBW. On this submission, learned counsel for the Applicant prays for liberty to withdraw this application and to prefer appropriate proceedings in accordance with law.

Liberty as prayed for is granted. The Application is disposed of with such liberty.
