On expressing the propriety in granting transit bail in the wake of the fact that the subject F.I.R. is fled on 28/05/2022 and the applicant has approached this Court on 04/06/2022 when it was very well open for him to approach the competent Court in Rajasthan where the F.I.R. is registered, the learned counsel for the applicant makes a categorical statement that, he shall be approaching the

2/3 4 ABA-1498-22.doc competent Sessions Court in Rajasthan within whose jurisdiction the subject F.I.R. falls, on Monday i.e. 13/06/2022. The learned counsel, therefore, seeks protection till 14/06/2022.

Though I have already expressed to the learned counsel that the exigencies of his imminent arrest are not made out from the application, since a statement is coming from the learned counsel for the applicant that the application shall be moved before the competent Court on 13/06/2022, I am inclined to grant transit bail for a period commencing from 11/06/2022 till 14/06/2022. Hence the following order. : ORDER :

(a) In the event of arrest in connection with C.R.No.0174 of 2022 registered with Rajnagar Police Station, District :Rajsamand, Rajasthan, applicant-Rakesh Rajendrakumar Agarwal shall be released on transit bail on furnishing P.R. bond to the extent of Rs.25,000/- with one or two sureties of the like amount for a period commencing from 11/06/2022 to 14/06/2022.

(b) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with facts of case so as to dissuade him from

3/3 4 ABA-1498-22.doc disclosing the facts to Court or any Police Offcer and should not tamper with evidence.

(c) It is made clear that I have not expressed any opinion on the merits of the matter and the competent Court shall not take grant of transit bail as a protection from arrest granted in favour of the applicant in the subject C.R. 3.

The application stands disposed off in the aforestated terms.
