Heard learned Counsel for the applicant and the learned A.P.P for the State.

By this application, which is filed by the applicant through jail, the applicant has prayed for fast tracking his case and for giving him permission to contact his family.

As far as expeditious hearing of the case is concerned, learned A.P.P on the instruction of the Officer, who is present in Court, states that in the said case, charge has been framed and two witnesses out of eighteen witnesses have been examined so far. He submits that the next date in the trial Court is 31st March, 2016. Since the evidence has already commenced, it is not necessary to give any directions to the learned Special Judge, City Civil & Sessions Court, Greater Mumbai, who is seized of the case.

As far as giving permission to contact his family is concerned, the applicant is at liberty to move an application before the learned Special Judge, who shall decide the same.

Application is disposed of accordingly.

The Additional Commissioner of Police, Local Arms, Mumbai, to ensure that the applicant is produced before the Special Judge, City Civil & Sessions Court, Greater Mumbai, on every date of hearing. 2/3

Copy of this order be forwarded to the learned Special Judge, who is seized of the case as well as to the Additional Commissioner of Police, Local Arms, Mumbai. Copy of the order also be forwarded to the applicant, who is lodged in Arthur Road Jail. REVATI MOHITE DERE, J.
