This is the second Anticipatory Bail Application filed by the applicant/accused, who is mother-in-law of the complainant. The applicant/accused is prosecuted for the offence punishable under sections 498A, 406. 323, 506(2), 504 r/w. 34 of Indian Penal Code in C.R. No. 329 of 2015. The offence is registered with MIDC Police Station. The First Anticipatory Bail Application No. 1610 of 2015 of the mother-in-law and husband of the complainant was rejected by the order dated 12th April, 2016.

The learned counsel for the applicant/accused has submitted that the husband of the complainant surrendered before the learned Additional Chief Metropolitan Magistrate, 22nd Court, Andheri, Mumbai and he is granted bail on 18th April, 2016. He submitted that the mother-in-law also 1 / 2
ABA939_2016.doc wants to surrender before the learned Magistrate, however, the police are not arresting her.

Learned APP opposed the Application.

There is no change of circumstances. Hence, the second Anticipatory Bail Application filed by the applicant/accused cannot be entertained and the same is rejected.
