The Petitioners challenge a notice issued by the Respondent Corporation under Section 478(1) and 433(c ) of the Maharashtra Municipal Corporation Act, 2012.

Counsel appearing for the Petitioners submit that the Petitioners were to file an application for regularization. This petition is pending since 2015.

Without expressing any opinion we observe that if an

WP.5158/2015(38) application is filed for regularization under Section 44 of the Act, it shall be dealt with in accordance with law at the earliest. In case the Petitioners did not file any application for regularization of the subject structure, the Corporation is at liberty to deal with the matter in accordance with law.
