Heard learned counsel for the Applicant and the learned APP for the Respondent - State.

By this Application, the Applicant seeks suspension of his sentence & enlargement on bail, pending the hearing and final disposal of the aforesaid Appeal.

Perused the papers.

The Applicant has been convicted for the offence punishable under Section 7 of the Prevention of Corruption Act
and has been sentenced to suffer S.I. for six months and to pay a fine of Rs.500/-, in default to suffer S.I. for one month. He has also been convicted for the offence punishable under Section 13(1)(d) r/w.13(2) of the Prevention of Corruption Act and has been sentenced to suffer S.I. for one year and to pay a fine of Rs.500/-, in default to suffer S.I. for three months. Both the sentences are directed to run concurrently.

The Applicant has been convicted and sentenced as aforesaid by the learned Additional Sessions Judge, Thane vide Judgment and Order dated 06.05.2017. After his conviction, the learned Sessions Judge was pleased to suspend the Applicant's sentence till filing of the Appeal. The Appeal has been admitted by a separate order passed today. The Applicant was on bail during his trial and has not misused or abused the conditions of bail. The Appeal is not likely to be heard in the immediate near future. Considering the fact, that the Applicant was on bail pending the trial and the short term sentence imposed on the Applicant, the Applicant's sentence is suspended and he is enlarged on bail pending the hearing and final disposal of the Appeal, on the following terms & conditions:-
O R D E R (i) The Applicant be enlarged on bail, on executing PR Bond in the sum of Rs.10,000/- with one or two sureties in the like amount.

Accordingly, the Application is disposed of on the aforesaid terms.
