The Learned Counsel appearing on behalf of the Appellant Mr. Y. B. Pawaskar on instructions of the Appellant who is personally present in Court and whom he identifies, seeks withdrawal of the above First Appal. The First Appeal is accordingly allowed to be withdrawn and dismissed as such. The Learned Counsel Mr. Y. B. Pawaskar however states that the Appellant has no objection to the Respondent withdrawing the amount of Rs.26,200/- deposited in the City Civil Court by the Appellant as also amount of Rs.26,166/- deposited by the Appellant in this Court with accrued interest if any. Statement accepted. The Respondent would accordingly be entitled to withdraw the said amount from the City Civil Court, Greater Bombay as well as this Court.
