The learned counsel appearing for the first respondent - Municipal Corporation, on instructions states that the said Municipal Corporation will withdraw the impugned order, Exhibit - H to the petition, only insofar as, the petitioner is concerned. He states that after giving a show-cause-notice to the petitioner and after giving an opportunity of being heard to the petitioner, the first respondent - Municipal Corporation will pass a fresh order.

We accept the aforesaid statements made on instructions. Hence it is not necessary to entertain this petition. In view of the aforesaid statements, the petition is disposed of. All contentions are kept open.
