After arguing for some time, the learned counsel for the petitioner seek leave to withdraw the present petition with liberty to file appropriate proceeding for transfer of S.C.Suit No.272 of 2012 filed by respondent plaintiff in the court of Civil Judge, Senior Division, Sangli to the appropriate court.

To that effect, advocate for the petitioner is given in writing on Farad. Same is taken on record and marked 'X' for identification.

Same is permitted.

a) Writ Petition stands dismissed as withdrawn with liberty as prayed.

b) Liberty granted to the petitioner bank to file appropriate application for transfer of S.C.Suit No.272 of 2012 from the court of Civil Judge, Junior Division, Sangli to the appropriate court. c) Ad-interim relief granted by this court on 13.6.2013 staying further hearing of S.C.S.No.272 of 2012 to be continued for six weeks from today. d) All contentions of both the parties are kept open on all the issues.
