The Applicant along with co-accused has been chargesheeted for the offence punishable under Section 395 of IPC in Crime No. 191 of 2019 of Police Station Bundgarden, Pune.

The aforesaid crime is registered on the basis of the complaint lodged by Mamusingh Chitodia.

I have heard the learned counsel for the parties. 4.

It is not disputed that the co-accused, who have been released on bail were not identified in the Test Identification Parade. Insofar as the present Applicant is concerned, he has Sneha Chavan page 1 of 2

7 ba 2285-21=.doc been identified in the Test Identification Parade and there is recovery of the ornaments from him. That apart, the learned APP also points out that there are criminal antecedents against the Applicant of offence under Section 394, 399 of IPC. 5.

No case for grant of bail is made out at this stage. Criminal application is rejected with liberty to the Applicant to renew the request after one year, if there is no progress in the trial 6.

Trial is expedited.
