Heard learned counsel for the parties.

By this application, the Applicant seeks his enlargement on bail in connection with C.R.No.214 of 2017 registered with the Karmala Police Station, Solapur for the alleged offences punishable under Section 354, 354(d), 341, 506 of the Indian Penal Code and under Section 8 of Protection of Children from Sexual Offences Act.

Learned Counsel for the applicant states that the applicant is 21 years of age and has been in custody since 13th April, 2017. He submitted that the allegations as against the applicant are, that he would follow the complainant, express his love for her, SMS her, and send chits to her. He submits that it is also alleged by the complainant that he compelled her to meet him, failing which he would circulate her photograph to his friends on WhatsApp. He states that the applicant has just completed his 12th standard and that he intends to take admission for the first year, in college. He submitted that the Applicant is ready to abide by any of the conditions which may be imposed by this Court. 4.

Learned APP does not dispute the allegations made by the complainant. He submitted that stringent conditions may be imposed on the applicant, while granting bail.

Perused the papers. The complainant is aged 17 years. She has alleged that the applicant would follow her to school and would express his love for her. She has alleged that the applicant would say that if she did not reciprocate his love, he would put up her photograph on the WhatsApp of

3/4 his friends. She has further alleged that the applicant would also send her chits. The applicant has been in custody since 13th April, 2017. 6.

Considering the aforesaid, the application is allowed and the applicant is enlarged on bail on the following terms and conditions:-

ORDER

i) The Applicant be enlarged on bail on furnishing P.R. Bond in the sum of Rs.15,000/- with one or two sureties in the like amount; ii) The Applicant shall attend the concerned Police Station, on the first Monday of every month, between 10:00 a.m. to 11:00 a.m., for a period of 12 months;

iii) The Applicant shall inform his latest place of residence and mobile contact number immediately after being released and/or change of residence or mobile details, if any, from time to time to the trial Court as well as to the concerned Police Station, in writing; iv) The Applicant shall not threaten, intimidate or send text messages to

4/4 the complainant, witnesses or any person concerned with the case; v) The Applicant shall not contact the complainant, witnesses or any person concerned with the case;

vi) The Applicant shall co-operate in the conduct of the trial; 7.

The Application is allowed and disposed of in above terms. 8.

It is made clear that the observations made herein are prima facie and are confined to this application and the learned Judge to decide the case on its own merits, uninfluenced by the observations made herein. 9.
