Mr. Naidu, the learned Counsel for the Appellant informs that Letters Patent Appeal (ST) No.15832 of 2005 in First Appeal No.696 of 2001, in fact, has not been presented by H. Fillunger & Company Pvt. Ltd.. However, the appeal bearing Letters Patent Appeal (ST) No.15833 of 2005 in First Appeal No.696 of 2001, was presented by the Employees State Insurance Corporation ("ESIC").

The Letters Patent Appeal (ST) No.15833 of 2005 in First Appeal No.696 of 2001, presented by the ESIC, has been disposed of by the Division Bench of this Court on 1st September, 2008.

In view of disposal of the appeal presented by ESIC, there is no need to reconstitute the record of the instant appeal. Since no such appeal is stated to have been presented by the appellant - H. Fillunger & Company Pvt. Ltd., Letters Patent Appeal (ST) No.15832 of 2005 in First Appeal No.696 of 2001, shall be presumed to have been disposed of.
