The learned counsel for the applicant fairly admits that the anticipatory bail application fled by him, bearing No.881 of 2022 is pending before the Sessions Court, Dindoshi and it's next date is 07/07/2022.
He, however, has expressed an apprehension that because of the Anticipatory Bail Application No.876 of 2022, being tagged alongwith his application, in which an application has been moved for transferring the same to some other Court, even his application may not be heard.

His concern can be taken care of by directing the learned Judge to decide the application fled by the applicant, irrespective of whether the other application is continued with him or not. Since it is an application for anticipatory bail, the learned Judge is reminded of the provision of the Maharashtra Amendment in Section 48 of the Cr.P.C. that he shall either pass an interim order or reject the application on merits. 3.
The learned counsel for the applicant states that the date of hearing is fxed upon the request of the counsel representing the applicant in another application. However, Mr.Saraogi vehemently submits that by consent, the matter is adjourned to 07/07/2022.

The present applicant is at liberty to take out an application for preponement of hearing of his application and it is upon the learned Judge to consider the same. 5.
With the aforesaid directions, the application stands disposed off.
