The petitioner challenges the order dated 26th April, 2016 passed by the Sessions Court, Ratnagiri on the application at Ex.124 filed by him. The application was for exemption from appearance on 26th April, 2016. The Sessions Court by the order passed on that date granted the application for that date and directed the petitioner to remain present on the next date. Mr. Killedar, the learned advocate for the petitioner submits that the challenge to the order in the present petition is limited to the direction to the petitioner to remain present on the next date. 2.
Perusal of Ex.124 shows that the application for exemption therein was restricted for only one day. Therefore the direction to the petitioner to remain present on the next date was an obvious direction. Besides the direction, in fact,
ssk 2/2 WP 1941/16-17/1/17 must be treated as superfluous because even if it did not form part of the order the petitioner had to remain present in the Court on the next date. The present petition is clearly a misconceived petition. The same is accordingly dismissed. [Smt. R. P. SondurBaldota, J.]
