IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CIVIL APPELLATE JURISDICTION WRIT PETITION NO. 6510 OF 2014 Vishnu Tukaram Patil .. Petitioner V/s The Deputy Collector (Acquisition) & Ors.

.. Respondents Mr. Rahul Thakur for the petitioner.

Mrs. M.P. Thakur, AGP for the State.

Mr. G.S. Hegde for CIDCO.

CORAM: DR. MANJULA CHELLUR, CJ. & G.S. KULKARNI, J.

DATE : 11th APRIL 2017 P.C.:

Heard learned counsel for the petitioner as well learned counsel for the respondent - CIDCO.

2.

On earlier occasion, the petitioner's counsel submitted that prayers (a) and (b) sought in the writ petition are not being pressed and his only grievance would be payment of compensation at an early date. Though such prayer was not made in the petition, we requested Mr. Hegde appearing for CIDCO to secure instructions. On instructions, Mr. Hegde submits that the quantum of compensation in terms of 2013 award is quite huge, therefore there is likelihood of challenging the same.

WP 6510-2014 3.

In that view of the matter, in the light of giving up prayers (a) and (b), nothing remains for us to consider in this writ petition. Accordingly the writ petition is disposed of as infructuous. The petitioner is at liberty to take recourse for payment of compensation in accordance with the procedure contemplated. (G.S. KULKARNI, J.) CHIEF JUSTICE ABS
