There is no reason to interfere with the impugned order at this stage. However, in case RAD & E Suit No.1288/1929 of 2009 is ultimately decided against the Petitioner herein, then liberty is reserved to the Petitioner to question the impugned order, along with the final order that may be made in the suit. 2.

With the aforesaid observation, the present Writ Petition is dismissed. It is made clear that this Court has not examined the matter on its merits and therefore, should the occasion arise to challenge the impugned order, the concerned Appeal Court will examine the validity of the impugned order on its own merits and in accordance with law.
