Heard. This application is filed for relaxation of condition imposed upon applicants by the learned Sessions court by its order dated 4th November 2015 when the application for grant of anticipatory bail was allowed and applicants were directed to mark their presence with Oshiwara Police Station on every Monday and Tuesday between 11 am to 12 noon till filing of charge-sheet. Learned counsel for applicants states that there are in all nine accused in the present crime and learned Sessions court had already relaxed condition imposed upon the said accused. However, no such relief was granted to avk 1/2
28-APPLN-327-2016.doc applicants. It is submitted that applicants being businessmen find difficult to mark their presence with Oshiwara Police Station on every Monday and Tuesday, which they are regularly marking since last nine months.
Learned APP for want of instructions, is unable to say if charge-sheet is filed or otherwise and states that application be disposed of by directing applicants to mark their presence on first and last sunday of every month. In that view of the matter, following order is passed :
i) Applicants shall mark their presence with Oshiwara Police Station between 11 am to 12 noon on first and last Sunday of each month till the filing of charge-sheet.
Application is disposed of accordingly.
