IN THE HIGH COURT OF JUDICATURE AT BOMBAY CRIMINAL APPELLATE JURISDICTION WRIT PETITION NO. 2196 OF 2015 Gopal Kashiram Tawde.

State of Maharashtra & Others.
..Respondents.
Mr. Gopal K. Tawde, the Petitioner in-person. Mrs. P. H. Kantharia, learned APP for the State. Mr. Y. P. Deshmukh, PSI Koparkhairane Police Station. Coram : RANJIT MORE & SMT. ANUJA PRABHUDESSAI, JJ.
Date : August 3, 2015.
P. C. :
1.
The petition is filed seeking direction to the Respondent - police authorities to register an FIR on the basis of the Petitioner's complaint-FIR at page No.113. There is no dispute that already FIR is registered by Koparkhairane Police Station, being CR.No.35 of 2014, for the offence punishable under sections 406, 465 and 467 of the Indian Penal Code, 1860. 2.
The grievance of the Petitioner is that though the FIR is registered as long as back on 2nd March 2015, the police are not investigating it in proper manner and direction. patilsr 1 / 2
3.
Learned APP for the State, after taking instructions from the officer concerned, makes a statement that investigation into the said FIR is complete and police is intending to file "CSummary" Report. That will be done within a week. Statement is accepted.
4.
In view of the statement made by the learned APP, nothing survives for consideration in the writ petition and the same is dismissed.
5.
Needless to mention that the Petitioner is at liberty to approach the learned Magistrate and file Protest Petition when police file C-Summary Report. We only observe that the learned Magistrate will dispose of the Protest Petition, if filed by the Petitioner, at the earliest possible for him. [SMT.
