Heard learned counsel for the parties.
By this application, the applicant seeks relaxation of the condition set out in clause (ii) of para 6, imposed by this Court (Coram: Revati Mohite Dere, J.) vide order dated 20th April 2015, passed in Bail Application No.464 of 2015. The condition of which relaxation is sought, reads thus:- 1/3
"6.

(ii) The applicant shall attend the concerned police station i.e. Manpada Police Station on the first Saturday of every month between 10:00 a.m. to 12:00 noon, till the conclusion of the trial."
Learned counsel for the applicant submits that the applicant has been diligently attending the concerned police station as directed by this Court vide clause (ii) of the order dated 20th April 2015, since 2015, till date. He submits that the applicant will attend the trial Court on every date, except in exceptional circumstances and that the applicant will cooperate in the conduct of the trial.
Learned A.P.P does not dispute the fact that the applicant has been attending/reporting to the concerned police station. This Court vide order dated 20th April 2015 passed in the applicant's bail application being Bail Application No. 464/2015 imposed certain conditions whilst enlarging the applicant on bail in C.R. No. I301/2014 registered with the Manpada Police Station, Thane. It appears that the applicant has been reporting to the concerned police station i.e. 2/3
Manpada Police Station on the first Saturday of every month between 10:00 a.m to 12:00 noon, as directed by this Court. Till date, the trial of the applicant has not commenced.
Considering the statement made by the learned counsel for the applicant, on the instructions of the applicant that the applicant will attend the trial Court on every date, except in exceptional circumstances, the application is allowed. The aforesaid condition set out in clause (ii) of para 6 of order dated 20th April 2015 passed in Bail Application No.464/2015, stands relaxed, inasmuch as, the applicant is now not required to attend the Manpada Police Station, Thane. However, the applicant shall attend the concerned Court and shall co-operate in the conduct of the trial. Rest of the conditions imposed vide order dated 20th April 2015, to remain as it is.
The Application is disposed of in above terms. All concerned to act on the authenticated copy of this order. REVATI MOHITE DERE, J.
