The learned prosecutor submits that in this case out of 36 witnesses 17 witnesses are examined.

It is to be noted that this Court by its order dated 15th December, 2014 has directed the trial Court to complete the trial as expeditiously as possible in any event by the end of 31st October, 2015 saving just exception. In the order dated 27th May, 2015 the learned Sessions Judge, AlibagRaigad has mentioned that the case is part-heard and seven witnesses has been examined and the trial is likely to be completed on or before 31st October, 2015.

The learned counsel for the applicant/ accused submits that he has moved this application on parity as he was given permission to move the application.

The learned counsel for the applicant /accused is wrong in construing the order passed by this Court dated 15th December, 2014. This Court has given time limit as 31st October, 2015 which is yet to come and moreover the learned Sessions Judge has mentioned that he is likely to complete the trial on or before 31st October, 2015. 5.

Under these circumstances, the application stands rejected.
