1] Applicant is seeking regular bail in C.R. No. I-74/2021 registered with Mumbra Police Station for offence punishable under Sections 307, 392, 367, 328, 363, 342, 323, 141, 143, 144, 147, 148, 149 of the Indian Penal Code.

2] Case of the prosecution is, applicant assaulted the complainant as he was having affair with the daughter of the applicant. 1/3

3] Prayer for grant of bail is opposed by the learned APP on the ground of antecedents and direct evidence available on record. 4] It appears that what has been alleged by the complainant in the complaint does not match with that of injury certificate as exaggeration can be noticed.

5] Apart from above, other co-accused are already released on bail but for the applicant.

6] Even if there are antecedents, same does not appear to be serious in nature. As such, in my opinion, applicant deserves grant of bail.

(i) Applicant be released on bail in C.R. No. I-74/2021 registered with Mumbra Police Station for offence punishable under Sections 307, 392, 367, 328, 363, 342, 323, 141, 143, 144, 147, 148, 149 of the Indian Penal Code upon furnishing P.R. bond in the sum of Rs. 15,000/- with one or more sureties in the like amount.

(ii) Applicant shall neither influence witnesses in any manner nor tamper with evidence.
