1.
This is an application seeking transit anticipatory bail in connection with F.I.R.No.12 of 2016 registered with Indore Crime Branch, Indore police station for the offence under sections 420, 465,467,468 read with section 120B of IPC. 2.
The Applicant had earlier approached this Court seeking similar relief vide Anticipatory Bail Application No.1137 of 2016. This Court had granted interim protection for a period of four weeks by an order dated 7.7.2016. The learned Advocate appearing for the Applicant pointed out that in pursuant to the
said order, the Applicant had approached the concerned police station. Subsequently, a letter was issued by police which is annexed at page 30 wherein it was mentioned that the Applicant is not involved in the said case. However, subsequently, an Application appears to have been moved before the concerned Court by the investigating machinery seeking warrant of arrest. Thereafter, on 22.5.2017 the father of the Applicant to whom earlier interim protection was granted is arrested. Hence, the applicant has preferred this application.
3.
This is a second Application seeking transit anticipatory bail. However, considering the fact that as indicated in the letter referred to above, the applicant was exonerated in the said case, the applicant did not move the competent Court seeking any relief as there was no apprehension of arrest. However, all of a sudden, father of the Applicant is arrested and he is in custody. 4.
In the light of the above circumstances, case is made out for grant of protection to the applicant so that he can move the concerned Court for appropriate reliefs.
