1] Applicant is seeking regular bail in C.R. No. 12/2020 registered with Vakola Police Station for offence punishable under Sections 3, 6 of Passport Act r/w 3(1) & 14 of Foreigners Act. 2] Maximum punishment prescribed under Section 14 of the Foreigners Act is informed to be 5 years and the applicant has already undergone the period of more than one year.

3] Though the applicant claims to be possessing the Aadhar Card, 1/2

48.2283.21 BA.doc that by itself will not confer nationality on him as he has to prove that he is Indian national.

4] In the aforesaid background, merely because applicant is a foreign national, that by itself will not dis-entitle him to claim the relief of bail. Hence, following order.

(i) Applicant be released on bail in C.R. No. 12/2020 registered with Vakola Police Station for offence punishable under Sections 3, 6 of Passport Act r/w 3(1) & 14 of Foreigners Act upon furnishing P.R. bond in the sum of Rs. 15,000/- with one or more local sureties in the like amount.

(ii) Applicant shall neither influence witnesses in any manner nor tamper with evidence.

(iii) Applicant shall attend concerned police station on Monday of every week till the conclusion of the trial. 5] Application stands disposed of.
