Learned Counsel for the appellant seeks to delete respondent No.2 which is a partnership firm. He invites my attention to clause

(3) of the Consent Terms wherein the appellant/original plaintiff states that he is withdrawing the suit as well appeal against the said respondent.

Parties have tendered Consent Terms. The appellant as well as the respondent No.1 are present before the Court. The learned Counsel for the parties have identified their respective clients. The Consent Terms are signed by both, the Constituted Attorney as well as respondent No.1. The Consent Terms are taken on record and marked "X" for identification.

In view of the amicable settlement of the dispute, the Appeal stands disposed of as per recitals of the Consent Terms. Pending application/s, if any, also stand disposed of. The original power of attorney be returned to the learned Counsel for the respondent No.1.
