Learned Counsel for the petitioners point out that the first tender process initiated on 28th February, 2015 was subject matter of challenge and this Court caused interference in favour of the petitioners and directed not to issue work order. The respondents thereafter proceeded to initiate a fresh tender process by issuing tender notice on 24th April, 2015. The said tender process was abandoned by the State since certain deficiencies were noticed.

In the instant petition challenge is raised to the third tender process initiated on publication of tender notice dated 4th April, 2016. It is informed that by passage of time since the process is already complete and the work order has already been issued, the instant petition is rendered infructuous.
