IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CIVIL APPELLATE JURISDICTION WRIT PETITION NO. 4978 OF 2013 Mrs. Nishigandha Narendra Jadhav .... Petitioner.

V/s The State of Maharashtra and Others ..... Respondents.

Mr. N.V. Bandiwadekar, Advocate for the Petitioner. Mr. A.A. Alaspurkar, AGP for Respondent Nos. 1 and 2. CORAM: B. R. GAVAI & SANDEEP K. SHINDE, JJ.

DATE: 5th October, 2017 P.C.:- 1] Petitioner has approached this Court for direction to treat the appointment of the Petitioner as full time teacher in Respondent No.4 - College.

2] It is the contention of the Petitioner that since the proposal by the Management for full time appointment of the Petitioner was submitted in 2003-2004, Petitioner should be granted salary from the said date.

3] We find that the Petition is totally misconceived. After the proposal was forwarded by the Management, Petitioner came to be 1/2

930-wp-4978.13 appointed for the first time on 01/12/2006 as Shikshan Sevak. Petitioner has unilaterally accepted that appointment. After completion of three years i.e. in the month of January, 2010 the Petitioner could have been treated as full time teacher. Thereafter, after a period of three and half years, present Petition has been filed. 4] Petitioner, having unilaterally accepted the appointment in 2006 as Shikshan Sevak, she cannot be allowed to turn around and claim much more than what she deserves. Petition is rejected. (SANDEEP K. SHINDE, J. ) (B. R. GAVAI, J. ) 2/2
