Mr.Godbole, learned counsel for the applicant seeks liberty to withdraw this civil application with liberty to file appropriate proceedings before the Small Causes Court in R.A.Suit No.951 of 2010. Civil application is dismissed as withdrawn with liberty as prayed. It is made clear that this court has not expressed any views on the merits of the matter. All the contentions of both the parties on merits of the application which is sought to be drawn and that would be filed are kept open. No order as to costs.
