Mr. Gaikwad submits that petition was filed challenging the order dated 12th May, 2016 passed by the Hon'ble Minister Co-

No. 6421-2016 operation, Marketing and Textiles granting stay to the order dated 30th April, 2016 passed by the Additional Commissioner and Special Registrar Co-operative Society Maharashtra State, Pune. During the pendency of this petition, Hon'ble Minister has finally allowed Revision Application on 5th April, 2017 and, therefore, this petition is rendered infructuous. He seeks permission to withdraw this petition with liberty to challenge the order dated 5th April, 2017 passed by the Hon'ble Minister.

Mr. Deshmukh submitted that if the Court is inclined to grant liberty to challenge the order dated 5th April, 2017, all the contentions of the parties may expressly be kept open. 4.

In view thereof, on the motion made by Mr. Gaikwad, petition is allowed to be withdrawn with liberty to challenge the order dated 5th April, 2017 passed by the Hon'ble Minister. All the contentions of the parties are expressly kept open. Grant of liberty shall not be construed as an expression of merits either way. Order accordingly.
