1] This is an application under Section 438 of Cr. P.C. for pre-arrest bail on an apprehension that the Police attached to Arnala Police Station, Taluka Virar, District-Palghar may arrest the applicant. 2] The learned APP on instructions from Police Hawaldar Mr. Nikumbh, attached to Arnala Police Station submitted that, till date no crime (first information report) has been registered against the applicant. 3] In view thereof, prima facie it appears that the applicant has no reasonable and bonafide apprehension of arrest in a crime registered with Arnala Police Station, Taluka-Virar, District-Palghar for the facts mentioned in the application.

aba.962-2018.doc 4] However, in case of any crime (first information report) is registered against the applicant at Arnala Police Station pertaining to the facts mentioned in the present application, the Senior Inspector of Police of the said Police Station is hereby directed to give 48 hours notice to the applicant before his arrest.

5] The application is accordingly disposed off with the aforesaid direction.
